Hiring temps in Québec: what the law expects from you
Québec regulates personnel placement agencies with a permit issued by the CNESST (Commission des normes, de l'équité, de la santé et de la sécurité du travail). Since 2020, an agency needs that permit to operate in Québec, and it is valid for two years. Several obligations also apply to you as the client business:
Check the permit
A business that uses a placement agency must make sure the agency holds a CNESST permit and appears in the public registry of permit holders.
Shared liability for unpaid amounts
The agency and its client business are jointly liable for the amounts owed to agency workers under the Act respecting labour standards, such as unpaid wages.
Shared health and safety duties
The agency and the client business are jointly responsible for protecting the health and safety of assigned workers, and can't transfer those obligations to each other by contract.
Same rate for the same work
An agency can't pay an assigned worker a lower hourly rate than your own employees doing the same tasks in the same establishment only because of their employment status.
Hiring an agency worker
After six months of assignment, you can hire the worker, and the agency can't prevent it.
How to check an agency in a few minutes
- Ask the agency for its CNESST permit number.
- Search the CNESST registry by the agency's name, permit number or Québec enterprise number (NEQ).
- Confirm the status is valid today: permits last two years and the CNESST can suspend or revoke them.
- Keep a copy of the check with your contract.
