Aukazi Enterprises Inc. is a corporation duly incorporated under the laws of Quebec, having its head office located at 54 rue de la Valline, Notre-Dame-de-l’Ile-Perrot, Quebec, J7V 9S5 Canada (“AUKAZI”, “we” or “us”) operates the Aukazi platform and and mobile application (the “Site”). The platform serves to provide a self-service platform for workers and employers to connect for urgent warehouse jobs.

This privacy policy describes how we collect, use and disclose your personal information and how this personal information can be consulted and corrected when necessary. This policy also explains how cookies are used on our website and mobile application.

LOG DATA AUTOMATICALLY COLLECTED

Like many site and mobile application operators, the Site is developed to collect certain non-identifiable information in an automatic manner (“Log Data”). This Log Data may include information such as your Internet Protocol (IP) address, date and time of website visit, source of your visit to the website, device and operating system, versions and protocols, visited pages and sections of the Site, downloaded materials. The above collected information is further employed in system administration purposes and enhances Site performance. Your collected Log Data may be disclosed to others or can also be permanently archived for future use or sale.

AUKAZI uses a variety of technologies to assess how our sites and mobile applications are used, to personalize your experience and to deliver online content tailored to your interests, such as internet tags, automatic data collection technologies, cookies and web beacons. Cookies are files that are installed on your computer hard drive or web browser in order to collect information such as your language of preference, browsing history and browser type and version all for the purpose of optimizing your experience on our Site. Web beacons are small electronic files that permit AUKAZI to count users who have visited those pages or and for other related website statistics. These technologies allow us to distinguish you from other users of this website, collect certain information about your equipment, browsing actions, and patterns, estimate our audience size and usage patterns, store information about your preferences, allowing us to customer this Site according to your individual interests, speed up your searches, and to enhance this Site and your experience when you browse this website.

In consideration of the availability, and your use, of the App, Site and the its Services, you agree, while visiting the App and Site, not to: (a) post, transmit, link to, or otherwise distribute any information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the App or any of the Services in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the App, the Services or the Internet; (b) defame, abuse, stalk, harass or threaten any other person or violate the legal rights of any other person, including without limitation, rights relating to privacy and publicity; (c) post, transmit, link to, or otherwise distribute any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information; (d) post, transmit, link to, or otherwise distribute any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component; (e) upload, post, publish, transmit, reproduce, link to or otherwise distribute in any way, information, software or other material obtained through the App or the Services, or any derivative work thereof, which is protected by copyright or any other intellectual property right, without obtaining permission of the copyright owner or rights holder; (f) impersonate or falsely represent your association with any person; and (g) use, reproduce, sell, resell or otherwise exploit the App or any of the Services for any commercial purposes.

RESPONSIBILITY FOR MINORS

In cases where you have authorized a minor to use our Services, you recognize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor's access to and use of our Services; and (iii) the consequences of any misuse of our Services by the minor. You acknowledge that some of the areas of our website may contain material that is inappropriate for minors.

During your Site visit, you may be asked to voluntarily disclose certain personal information (name, email address, postal address, city, social insurance number, banking information and telephone number through online forms).  Personal information does not include business contact information, including your name, title, or business contact information. AUKAZI may collect and use your personal information to present the Site, its content and features to you, to contact and correspond with you, to respond to your inquiries and provide you with information that you request from us, to notify you about upcoming events, products and/or services offered or provided by us, our affiliates and/or our franchisees that may be of interest to you, and as otherwise permitted by law. AUKAZI will utilize your social insurance number and/or your banking information solely for the purposes relating to the hiring and payment process and for no other purpose whatsoever.

USE AND COMMUNICATION OF YOUR PERSONAL INFORMATION

The log of user information can be used by third-party tools, platforms for brand marketing, CRM for lead management, marketing analytics for tracking the website traffic. By providing your personal data, you agree that, where it is permitted by local law or where you have agreed to receive these communications from us, we may use and disclose your personal information mainly:

• to respond to your requests via email, text and through any other means of communication including but not limited to electronic transmission;

• to provide you with tips, helpful information, product news, updates and to notify you of our new products and services;

Sharing of Personal Information AUKAZI may disclose personal information that we collect through the Site to advertisers and advertising networks that require the information to select and serve relevant advertisements to you and others, to contractors, service providers, and other third parties we use to support our business, subsidiaries, affiliates, franchisees and service providers for the purposes identified above. Only AUKAZI employees, affiliates, franchisees and service providers with proper authorization will have access to your personal information, and only to the extent necessary for the purposes described in this Privacy Policy. 

We may also disclose your personal information to comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law, to enforce or apply our terms of use and other agreements, including for billing and collection purposes and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of AUKAZI, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL (MERCHANT NAME), INCLUDING ITS AFFILIATES, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF PROFITS, SAVINGS, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER (MERCHANT NAME) HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE, INABILITY TO USE OR PERFORMANCE OF ANY OF THE SERVICES, OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR CONTENT OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO THE SERVICES, REGARDLESS OR WHETHER ANY OF THE FOREGOING IS DETERMINED TO CONSTITUTE A FUNDAMENTAL BREACH OR FAILURE OF ESSENTIAL PURPOSE.
